Copy of Photo Release

This is a copy of the photo release my clients are not required to sign, but it is appreciated so that I can continue to create content for my packages.

Photo Release [Not Mandatory]

This agreement is made between [Selina Photography], its legal representatives, assigns, and those acting under its authority (hereinafter referred to as “Releasees”), and the client (hereinafter referred to as “The Client”), and applies to photographic or video content taken during the session date.

1. Usage Rights

   
   

   The Client grants Releasees the following rights to the photographs, videos, or other media (the “Pictures”):

   • Copyright Ownership: The Photographer retains full copyright ownership of all Pictures, as per the Copyright Act of Canada.

   • License to Use: The Client grants Releasees the unrestricted right to use, reproduce, edit, publish, distribute, and publicly display the Pictures in whole or in part, in any media, for the following purposes:

     • Advertising or promotional content for Selina Photography, including website and social media use.

     • Portfolio and professional display (both online and offline).

     • Other lawful purposes consistent with the professional practice of photography.

   • Exclusions: The Client may request, in writing, to exclude specific images from public use prior to or within seven (7) days following the session.

2. Client’s Personal Use Rights

   
   

   The Client is permitted to use the Pictures for personal, non-commercial purposes. The Client agrees not to alter, edit, sell, license, or publish the Pictures without prior written consent from Selina Photography.

3. Social Media and Digital Sharing

   
   

   The Client consents to the Pictures being shared on social media platforms, websites, and marketing materials by Selina Photography.

4. Privacy and Personal Information

   
   

   Selina Photography complies with the Personal Information Protection Act (PIPA). Any identifiable information included in the Pictures will only be used as outlined in this agreement. Personal data will not be shared, sold, or otherwise disclosed to third parties without The Client’s explicit consent, except as required by law.

5. Waiver of Rights and Claims

   • The Client waives the right to inspect or approve the finished product, including any promotional materials that use the Pictures.

   • The Client releases Selina Photography and its assigns from any claims, demands, or actions arising from:

     • The proper use of the Pictures for lawful purposes.

     • Any unintentional distortion, alteration, or composite editing of the Pictures.

     • Any loss, damage, or injury sustained during the session, except where negligence on the part of Selina Photography is proven.

6. Indemnity

   
   

   The Client agrees to indemnify and hold harmless Selina Photography from any and all claims, including those related to personal injuries, property damage, or misuse of the Pictures by third parties.

7. Optional Agreement

   
   

   This release is optional. The Client is not obligated to sign and may choose to restrict public use of their Pictures by notifying Selina Photography in writing prior to the session.

8. Legal Jurisdiction

   
   

   This agreement shall be governed by the laws of the Province of British Columbia, and any disputes will be resolved in a court of competent jurisdiction within BC.

9. Acknowledgment of Understanding

   
   

   The Client represents that:

   • They are at least 18 years old and have full authority to sign this release.

   • They understand the terms of this agreement and voluntarily agree to them without coercion.
