This is a copy of the contract my clients are required to sign for any photoshoot outside of weddings or special packages.

Photography Contract Terms & Conditions
This agreement is dated today, between Selina Kozub, hereinafter referred to as “The Photographer,” and the client(s), hereinafter referred to as “The Client,” who agree to the following terms:
1. Services and Booking
The Client shall engage the services of The Photographer for photography on the agreed date, time, and location.
The agreed fee includes photography services as outlined in the booking. A non-refundable deposit is required to secure the booking. This deposit guarantees the reserved time and date and commences work. The remaining balance must be paid in full 48 hours prior to the session. Failure to do so may result in session cancellation, with the deposit forfeited.
If The Client is more than 10 minutes late, the deposit is forfeited, and the session may be canceled at The Photographer’s discretion.
Rescheduling Policy: The deposit is non-refundable if The Client reschedules more than twice. Cancellations within 14 calendar days require a new deposit for rescheduling.
Travel Fees: Additional charges apply for travel or location upgrades. These must be accurately calculated and paid during the booking process to avoid session cancellation.
2. Session Conditions
The Photographer will arrive before the scheduled time and depart after the paid session time is completed. Early arrivals by both parties may allow the session to begin early but will still conclude after the agreed session duration.
The Client agrees to follow The Photographer’s What to Wear Guide to enhance the session's outcome.
The Client must assist The Photographer in obtaining desired images (e.g., specifying scenes or persons to photograph). Failure to cooperate may limit photo opportunities and is not grounds for a refund.
The Photographer reserves the right to end or cancel a session if:
Communication from The Client is ineffective.
The Photographer feels unsafe, threatened, or mistreated.
The Photographer observes mistreatment of others, including animals.
3. Image Delivery
Proof photographs will be delivered via a private online gallery within 8 weeks. Delivery times may vary depending on workload.
Edited Images Only: The Client will receive only edited images chosen by The Photographer, reflecting the portfolio’s quality.
Unedited Images: The Client is not permitted to view, cull, or request unedited images.
Image Alterations: The Client may not re-edit, filter, or alter delivered images.
Image Selection: If The Client opts not to select or purchase additional images, this is not grounds for a refund.
The Client agrees not to save watermarked images.
4. Refund and Reschedule Policy
In cases where The Photographer cannot perform services due to unforeseeable circumstances (e.g., severe weather, acts of nature, or technical failures), the session will be rescheduled. If rescheduling is not possible, The Client will receive a refund of pre-paid fees only.
Refunds will not be granted for undelivered or missed images due to technical, natural, or other unforeseen circumstances beyond The Photographer’s control.
Refunds are processed back to the original payment method. If this fails, refunds will be issued via email transfer.
Body Dysmorphia Clause:The Photographer’s goal is to highlight The Client’s natural beauty through professional techniques, including posing, lighting, and editing. Dissatisfaction stemming from personal body image concerns, including body dysmorphia, is subjective and beyond The Photographer’s control. Therefore, body dysmorphia or dissatisfaction with personal appearance is not valid grounds for a refund or reshoot.
5. Equipment Damage
If The Photographer’s equipment is damaged due to The Client or their attendees, The Client will be held responsible for the repair or replacement costs.
6. Copyright and Usage Rights
The Photographer retains full copyright to all images. The Client is granted unlimited but non-exclusive rights to use and reproduce paid photographs for personal use only.
Upon the signing of the Photo Release, the Client consents to allow The Photographer to use images for marketing purposes.
7. Code of Conduct and Non-Disparagement
The Client agrees to maintain professional conduct throughout their interactions with The Photographer.
Non-Disparagement Clause: The Client agrees not to publicly slander, defame, or make negative statements about The Photographer, including on social media or review platforms, for any dissatisfaction or disputes. Any concerns should be addressed directly with The Photographer to seek resolution.
8. Governing Law
This contract is governed by the laws of the Province of British Columbia, Canada, and any applicable federal laws.
This agreement is valid for the place and date stated in the booking. By confirming the booking, The Client acknowledges they have read, understood, and agreed to all terms and conditions outlined above. This serves as a legal electronic signature and is enforceable in any court of law.
